Most of these cases have a high likelihood of being secondary to inflicted injury. Where cases reached court and the legal outcomes are known, the verdicts and sentences are included. Hopefully this collection will spur others to submit. The intention is to develop a large North American and international collection. Obviously the patient’s names and the doctors will be kept confidential. The most valuable cases will be those where the outcomes post evaluation by social service, child advocacy and SCAN teams and especially those which reached the legal system. Although we know the legal system, is not foolproof, it is as close as we can get with respect to whether inflicted injury has occurred. Those found innocent by the legal system are critically important as not all cases initially suspected, are found guilty by the legal system. Additionally those who have dealt with the legal system as expert witness for the prosecution and the defense, realize that legal decisions do not always equal truth, however this is an effort to show what agrees with legal precedent, which is the closest method that we have to differentiate guilt and innocence. I think we can make a difference especially if we encourage contributors to present defense cases, also, because we know that convictions, plea bargaining, and confessions are not reliable sources for evidence-based or scientific determinations of NAI vs. AI. We must also keep an open mind and look at both (all) sides of these cases. We must be aware of the mimics of CNS and skeletal injury especially since more mimics than we previously realized must be considered.
If you have cases please consider sharing. You can either submit them, which is really easy. If anyone needs help with the process there is a . When informed about new cases and their numbers I will add them to the collections. Mimics of child abuse will also be collected (see the next folder).
We should always remember “Individual Rights. Due Process of Law. A person is presumed innocent until proven guilty. Item quilibet presumitur innocens nisi probetur nocens.” Johannes Monachus, French cardinal and canonist, died in 1313 A.D. Digestum, Infortiatum, Vat. Palatina 742, fol. 109r
